This Privacy Policy explains how Kanoa Hawaii (the “Website,” www.kanoahawaii.com) collects, uses, and shares information about you. The Website is owned and operated by Pacific Whitecap, LLC (“Company,” “we,” “us,” or “our”). By using the Website, you agree to this Policy.

1) Who we are & scope

This Policy applies to information we collect online through our Website, checkout, and marketing tools (e.g., email). It does not cover third-party sites we don’t control.

2) What we collect

  • Identifiers & contact info: name, email, phone, shipping/billing address.
  • Order & payment details: items purchased, order totals, limited payment metadata (we do not store full card numbers).
  • Device & usage data: IP address, browser, pages viewed, timestamps, referral URLs.
  • Marketing preferences: newsletter opt-ins, campaign interactions.

Sources: you (forms/checkout), automatic collection (cookies, pixels), and service providers (e.g., fraud prevention, analytics).

3) How we use information

  • Fulfill orders & support (purchase, shipping, returns).
  • Operate, improve, and secure the Website (analytics, debugging, fraud prevention).
  • Marketing with consent/legitimate interest (newsletters, offers, product education via Klaviyo).
  • Legal compliance (tax, accounting) and to protect our rights.

4) Cookies, analytics & ads

We and partners use cookies/pixels to run the store, measure performance, and personalize marketing.

  • Analytics & ads: Google Analytics/Ads, Shopify analytics.
  • Email: Klaviyo (campaigns, automations, preference management).

Controls: browser settings, ad-preferences tools (NAI/DAA/EDAA), and our Cookie/Privacy Preferences links if enabled.

5) “Do Not Track”

Browsers may send DNT signals; we currently do not respond to DNT. Use the controls listed above to manage tracking.

6) Sharing information

We share information with:

  • Service providers/processors: Shopify (store/checkout/anti-fraud), Shopify Payments (including supported wallets such as Shop Pay, Apple Pay, and Google Pay), Amazon Pay, Klaviyo, shipping/carriers, and customer support tools.
  • Legal & safety: to comply with law, enforce our terms, prevent fraud.
  • Business transfers: in mergers, financing, or acquisition, subject to this Policy.

We do not sell personal information in the traditional sense. Some advertising/analytics uses may be deemed a “sale” or “sharing” under California law—see Section 9.

7) Payments

We use Shopify Payments to process most payments (and may offer Shop Pay, Apple Pay, and Google Pay). We also offer Amazon Pay. We do not store full card numbers; payment information is handled by these providers in accordance with their privacy policies and PCI-DSS requirements.

8) Retention

We keep data only as long as necessary for the purposes above (e.g., tax/accounting retention for orders), or as required by law.

9) Your privacy rights

California (CCPA/CPRA): rights to know/access, correct, delete, opt-out of sale or sharing, limit use of sensitive personal information, and non-discrimination.

EEA/UK (GDPR): rights to access, rectify, erase, restrict/object, portability, and withdraw consent. Legal bases include contract, legitimate interests (e.g., site security, analytics), consent (marketing), and legal obligations.

We may ask you to verify your identity before fulfilling a request.

10) International transfers

We operate in the U.S. and may process data in other countries. Where required, we use appropriate safeguards consistent with applicable law.

11) Security

We use commercially reasonable technical and organizational measures. No method of transmission or storage is 100% secure.

12) Children’s privacy

The Website is not directed to children under 13, and we do not knowingly collect their information.

13) Changes to this Policy

We may update this Policy. We’ll post the new date at the top; material changes will be highlighted as appropriate.
